1. Introduction

These Terms and Conditions ("Terms") govern your use of the website operated by Talvania Global Ltd, company number 16526014, registered office at Office 8168, 321-323 High Road, Chadwell Heath, Essex, United Kingdom, RM6 6AX ("we", "us", "our", or "Talvania Global"), and any enquiry, quotation or booking you make with us for flights, holidays, cruises, tours or any other travel-related product or service ("Travel Arrangements"). By accessing our website, submitting an enquiry, or making a booking with us, you confirm that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, Cookie Policy, Payment Policy and Booking Protection statement, each of which forms part of our agreement with you. If you do not agree with any part of these Terms, you should not use this website or make a booking with us.

2. Who We Are

We can be contacted by telephone on (0203) 983-6853, by WhatsApp, or via the contact form on this website. We are a travel agency that helps customers research, plan and arrange flights, package holidays, tours, accommodation and related travel services supplied by a wide range of third-party airlines, hoteliers, tour operators and other travel suppliers ("Suppliers").

3. Our Role as a Booking Agent

Unless we tell you otherwise in writing in relation to a specific booking, Talvania Global acts as a booking agent. This means that when you make a booking through us, in most cases we are arranging your Travel Arrangements as agent on behalf of the Supplier that will actually provide the flight, accommodation, transfer or other service to you, and your contract for that element of the trip is made directly with that Supplier and is subject to the Supplier's own booking conditions. Our own responsibility as agent is limited to arranging your Travel Arrangements with reasonable skill and care, in accordance with your instructions. Where we act as principal (for example, where we are the provider of a package holiday, or where required by applicable package travel regulations), we will make this clear to you before you book, and different terms relating to our responsibility as organiser may apply and will be provided to you at the time of booking. Full details of the applicable financial protection arrangements for your booking are set out in our Booking Protection statement.

4. Definitions

In these Terms: "Booking" means a confirmed reservation of Travel Arrangements made through us; "Lead Passenger" means the person who makes the Booking and who is responsible for the accuracy of all information provided and for payment of the total cost of the Booking on behalf of all persons named on it; "Supplier" means any airline, hotel, tour operator, cruise line, car hire company, insurer, transfer company or other third party that supplies any part of your Travel Arrangements; "Package" has the meaning given to it under the Package Travel and Linked Travel Arrangements Regulations 2018, where applicable; and "Website" means this website and any associated mobile applications operated by Talvania Global.

5. Website Use and Acceptable Use Policy

You may use our Website for lawful purposes only. You must not use our Website in any way that breaches any applicable local, national or international law or regulation, is fraudulent or unlawful, or has the purpose or effect of causing harm to us, our Suppliers or any other user. You must not attempt to gain unauthorised access to our Website, the server on which our Website is stored, or any server, computer or database connected to our Website. You must not attack our Website via a denial-of-service attack, scrape or harvest content from our Website using automated tools without our prior written consent, or introduce viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. Any breach of this provision may result in your right to use our Website ceasing immediately, and we reserve the right to report any such breach to the relevant law enforcement authorities.

6. Accuracy of Information

We take reasonable care to ensure that the descriptions, images, availability indicators and pricing displayed on our Website are accurate at the time of publication. However, prices, availability, itineraries, flight times, inclusions and other details relating to Travel Arrangements are supplied to us by our Suppliers and can change at short notice and without warning, including due to seasonal demand, currency fluctuations, fuel surcharges, taxes, and Supplier-driven revisions. Accordingly, any prices, savings, deal descriptions or example itineraries shown on our Website are indicative and for illustrative purposes only, and do not constitute a binding offer capable of acceptance. The definitive price, availability and terms applicable to your Travel Arrangements will always be confirmed to you in writing by one of our travel consultants before any payment is taken and before your Booking is confirmed.

7. Enquiries and Quotations

Browsing our Website, submitting a contact form, calling us, or messaging us via WhatsApp does not create a Booking or any binding obligation on either party. These actions constitute an enquiry only. Following an enquiry, one of our travel consultants will provide you with a personalised quotation based on live availability and current Supplier pricing. A quotation remains valid only for the period stated to you at the time it is given (or, if no period is stated, for 24 hours), after which the price and availability may change without notice. No contract exists between you and Talvania Global, or between you and any Supplier, until we have confirmed your Booking in writing and received the required payment as set out in Section 9 and in our Payment Policy.

8. How a Booking Is Made

To make a Booking, you must provide us with accurate and complete information about all passengers travelling, including full names exactly as they appear on the relevant passport or travel document, dates of birth, contact details and any special requirements. The Lead Passenger must be at least 18 years old and is responsible for the accuracy of the information provided for every person on the Booking, for the timely payment of all sums due, and for communicating all relevant information (including any changes) to the other passengers on the Booking. We recommend that you check all confirmation documents carefully as soon as you receive them and notify us immediately of any errors, as some Suppliers charge significant fees to correct even minor mistakes such as name misspellings once a Booking is confirmed.

9. Booking Confirmation and Contract

A Booking is only confirmed, and a contract only comes into existence, once we have issued a written booking confirmation and received cleared payment of the deposit or full balance (as applicable) in accordance with our Payment Policy. At that point, a contract for the relevant element of your Travel Arrangements exists between you and the applicable Supplier (where we act as agent) or between you and Talvania Global (where we act as principal or organiser of a Package, as notified to you). It is your responsibility to check that all details on your booking confirmation are correct and match your travel documents before you travel.

10. Prices and Price Changes

All prices quoted to you are in pounds sterling (GBP) unless expressly stated otherwise, and are only guaranteed once your Booking has been confirmed and paid for in full or, where a deposit scheme applies, once your deposit has been paid and your Booking confirmed. Where permitted by law and by the applicable Supplier's booking conditions, prices may be subject to surcharges after confirmation, for example due to changes in currency exchange rates, fuel or energy costs, or taxes and fees imposed by governments or airports. Where a surcharge applies, we will notify you as soon as reasonably possible and, where the increase exceeds the threshold permitted by law, you may in some circumstances have the right to cancel and receive a refund, as set out in the relevant Supplier's conditions.

11. Deposits and Payment

Full details of our accepted payment methods, deposit amounts, balance due dates and refund handling are set out in our Payment Policy, which forms part of these Terms. In summary, most Bookings require an initial non-refundable deposit to secure the arrangement, with the remaining balance due before a date specified at the time of booking. Failure to pay the balance by the due date may result in the automatic cancellation of your Booking by the Supplier, in which case cancellation charges as set out in Section 16 will apply.

12. Your Financial Protection

Details of how your payments are protected, including our arrangements with our IATA-accredited host travel agency, Brightsun Travel (IATA 3856), are set out in full in our Booking Protection statement. We strongly recommend that you read this statement before making any payment, and that you take out appropriate travel insurance at the time of booking to protect yourself against cancellation, medical expenses, lost baggage and other unforeseen events.

13. Passports, Visas and Health Requirements

It is your sole responsibility to ensure that you and every member of your party hold a valid passport with the minimum period of validity required by your destination (commonly at least six months beyond your return date, though requirements vary), any necessary visas, transit permits and other travel documentation, and to comply with all health requirements, including any recommended or mandatory vaccinations, for your destination. Requirements vary by nationality, destination and are subject to change, including at short notice. We can provide general guidance, but you should independently verify requirements with the relevant embassy, consulate or government website (such as the UK Foreign, Commonwealth & Development Office) well in advance of travel. We accept no liability for any loss or expense you incur as a result of your failure to comply with these requirements.

14. Special Requests and Medical Conditions

If you or anyone in your party has a medical condition, disability or reduced mobility that may affect your Travel Arrangements, or if you have any other special request (such as dietary requirements, seating preferences or celebratory occasions), please tell us at the time of booking so that we can pass this information on to the relevant Supplier. We will do our reasonable best to assist, but we cannot guarantee that any special request will be met, as this ultimately depends on the Supplier, and failure to meet a special request does not constitute a breach of contract on our part unless we specifically confirmed it in writing as guaranteed.

15. Changes Made by You

If you wish to change any aspect of a confirmed Booking, such as travel dates, destination, or passenger names, you should contact us as soon as possible. We will try to assist, but amendments are subject to the applicable Supplier's terms and availability, and most Suppliers charge an amendment fee in addition to any difference in price. Some elements of a Booking, particularly discounted or promotional airfares, may not be changeable at all once confirmed. We will always advise you of the applicable charge before proceeding with any amendment on your behalf.

16. Cancellations by You

If you wish to cancel a confirmed Booking, you must notify us in writing. Cancellation charges will apply in accordance with the relevant Supplier's booking conditions, which will have been provided or made available to you at the time of booking, and which typically increase the closer the cancellation is made to the departure date, up to and including 100% of the total cost. Deposits are generally non-refundable. Where we act as organiser of a Package, standard cancellation charges as set out in your booking confirmation will apply, save where you are entitled to cancel free of charge under applicable law (for example, due to unavoidable and extraordinary circumstances at your destination).

17. Changes and Cancellations by Suppliers or Us

Occasionally, a Supplier may need to make changes to, or in rare cases cancel, confirmed Travel Arrangements, for example due to operational, safety, commercial or regulatory reasons. Where we are notified of such a change, we will inform you as soon as reasonably possible and, where applicable, assist you in exercising any rights you may have under the Supplier's conditions, which may include accepting an alternative arrangement, accepting a refund, or (in the case of a significant change to a Package for which we act as organiser) cancelling and receiving a full refund or appropriate compensation, as required by applicable law.

18. Force Majeure

Neither we nor any Supplier will be liable for any failure to perform, or delay in performing, any obligation under these Terms or a Booking that is caused by events outside of our or their reasonable control ("Force Majeure Event"), including but not limited to natural disasters, extreme weather, fire, war, terrorism, civil unrest, industrial action, epidemic or pandemic, governmental action, airspace closures, and airline or airport strikes. Where a Force Majeure Event affects your Travel Arrangements, your rights will generally be determined by the relevant Supplier's own conditions and by applicable law.

19. Travel Insurance

We strongly recommend that all customers take out comprehensive travel insurance at the time of booking, covering at minimum cancellation, curtailment, medical expenses and repatriation, personal belongings, and personal liability, appropriate to your destination and planned activities. Travel insurance is not included in any Booking unless expressly stated, and it is your responsibility to arrange adequate cover. We are not liable for any losses that would have been covered by appropriate travel insurance.

20. Our Liability

Where we act as agent, our liability is limited to the proper performance of our obligations as agent, namely to arrange your Travel Arrangements with reasonable skill and care in accordance with your instructions. We are not liable for the acts or omissions of any Supplier, or for any death, injury, illness, loss, damage, delay or other claim of any description arising from the provision of Travel Arrangements by a Supplier, save where such loss arises directly from our own negligence or breach of contract as agent. Where we act as organiser of a Package, our liability is as set out in the applicable package terms provided to you at the time of booking, and is determined in accordance with the Package Travel and Linked Travel Arrangements Regulations 2018 and other applicable law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

21. Complaints Procedure

If you experience a problem with your Travel Arrangements while travelling, you should report it immediately to the relevant Supplier (for example, hotel reception or the tour representative) so that they have the opportunity to resolve the issue promptly. If the issue remains unresolved, please contact us as soon as possible using the details in Section 2, and in any event within 28 days of your return, providing your booking reference and full details of the complaint. We will acknowledge your complaint promptly and work with the relevant Supplier to investigate and respond as quickly as reasonably possible.

22. Passenger Conduct

You are responsible for your own behaviour and that of your party while travelling. Suppliers, including airlines, hotels and cruise lines, reserve the right to refuse boarding or accommodation, or to remove you from a service, if your behaviour is deemed disruptive, dangerous, or in breach of the Supplier's own conditions of carriage or house rules. In such circumstances, neither we nor the Supplier will be liable for any resulting cost, loss or curtailment of your trip, and you may be liable for costs incurred as a result of your conduct.

23. Data Protection

We process your personal data in order to provide our services to you, in accordance with our Privacy Policy, which explains what information we collect, how we use it, who we share it with (including relevant Suppliers necessary to fulfil your Booking) and what rights you have in relation to your data under the UK General Data Protection Regulation and the Data Protection Act 2018.

24. Intellectual Property

All content on this Website, including text, graphics, logos, images and software, is owned by or licensed to Talvania Global Ltd and is protected by copyright, trademark and other intellectual property laws. You may view and print pages from our Website for your own personal, non-commercial use only. You must not reproduce, republish, distribute or otherwise exploit any content from our Website for commercial purposes without our prior written consent.

25. Third-Party Websites and Links

Our Website may contain links to third-party websites, including those of our Suppliers. These links are provided for your convenience only. We have no control over the content of third-party websites and accept no responsibility for them or for any loss or damage that may arise from your use of them. The inclusion of a link does not imply our endorsement of the linked website.

26. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction to settle any such dispute or claim, save that if you are resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.

27. Severability

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be deemed deleted, and the remaining provisions of these Terms will continue in full force and effect.

28. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, our Suppliers' requirements, or applicable law. The version of these Terms in force at the time you make a Booking will apply to that Booking. We recommend that you review these Terms periodically for any updates. The date at the top of this page indicates when these Terms were last revised.
